The short version: Buy it, use it, get your life back. But don't resell it or claim it as your own. ImGenBlitz is a standalone tool. You are solely responsible for your own OpenAI usage and any images you generate. All sales are final. Digital products are non-refundable. Exceptions only when third-party sales platform(s) require it.
1. Agreement to Terms
These Terms of Service ("Terms") govern your purchase and use of ImGenBlitz ("the Software"), a standalone batch image generation tool created and sold by Karen Denning ("we," "us," or "our").
By purchasing or using ImGenBlitz, you agree to be bound by these Terms. If you do not agree, do not purchase or use the Software.
2. License
Upon purchase, you are granted a non-exclusive, non-transferable, personal license to use ImGenBlitz for your own personal or commercial projects. This license allows you to:
- Install and use ImGenBlitz on any devices you personally own or control
- Use ImGenBlitz to generate images for personal or commercial purposes
- Use images generated through ImGenBlitz in your own products, listings, courses, and publications
This license does not allow you to:
- Resell, redistribute, sublicense, or share ImGenBlitz with any other person or entity
- Claim ImGenBlitz as your own creation or remove copyright notices
- Modify and resell or redistribute a modified version of the Software
- Use ImGenBlitz as part of a service where third parties are given access to the tool itself
- Upload ImGenBlitz to any file-sharing platform, marketplace, or repository without explicit written permission
3. Digital Product — No Refunds
ImGenBlitz is a digital product delivered by instant download. Due to the digital nature of this product, all sales are final and non-refundable.
No refunds will be issued once the product has been delivered or downloaded. By completing your purchase, you acknowledge and agree to this policy. Please review the product description carefully before purchasing.
If you purchase ImGenBlitz through WarriorPlus or another third-party platform, that platform's refund policy applies in addition to or in place of this policy, depending on the platform's terms.
If you experience a technical issue that prevents the Software from functioning as described, contact us at support@imgenblitz.com and we will make every reasonable effort to resolve it.
4. OpenAI API Usage
ImGenBlitz is a Bring Your Own Key (BYOK) tool. It connects directly to OpenAI's API using your own API key. You are solely responsible for:
- Obtaining and maintaining a valid OpenAI account and API key
- All costs and charges incurred through your OpenAI account as a result of using ImGenBlitz
- Complying with OpenAI's Terms of Use and Usage Policies
- Ensuring that the prompts and content you generate comply with OpenAI's content policies
We are not affiliated with OpenAI and have no control over OpenAI's pricing, availability, policies, or the content their models produce. We are not liable for any charges, suspensions, or policy violations arising from your use of OpenAI's services.
5. Generated Images and Content
Images generated using ImGenBlitz are produced by OpenAI's GPT-Image-2 model using your prompts and your API key. Ownership and rights to generated images are governed by OpenAI's Terms of Use, not by these Terms.
You are solely responsible for:
- The prompts you submit and the images they produce
- Ensuring generated images do not infringe on third-party intellectual property rights
- Complying with any platform-specific rules (e.g., Etsy, Amazon KDP, Teachers Pay Teachers) regarding AI-generated content
- Any disclosures required by law or platform policy regarding the use of AI-generated content in your products
We make no warranties regarding the ownership, originality, or commercial usability of any images generated through the Software.
6. Acceptable Use
You agree not to use ImGenBlitz to generate content that is:
- Illegal under applicable local, national, or international law
- Harmful, abusive, harassing, threatening, or defamatory
- Sexually explicit or pornographic
- Designed to deceive, defraud, or mislead others
- In violation of OpenAI's content policies
We reserve the right to revoke your license without refund if we become aware of material violations of these acceptable use terms.
7. No Warranty
ImGenBlitz is provided "as is" without warranty of any kind, express or implied. We do not warrant that the Software will be error-free, uninterrupted, or compatible with all browsers, operating systems, or future versions of OpenAI's API.
OpenAI's API, pricing, models, and availability may change at any time without notice. We are not responsible for disruptions to ImGenBlitz's functionality caused by changes to third-party services, including OpenAI.
To the maximum extent permitted by applicable law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, Karen Denning shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of ImGenBlitz, including but not limited to:
- OpenAI API charges or overage costs
- Loss of data, images, or batch results
- Loss of revenue or business opportunity
- Damages arising from generated content
Our total liability to you for any claim arising from these Terms or your use of ImGenBlitz shall not exceed the amount you paid for the Software.
9. Intellectual Property
ImGenBlitz, including its code, design, and documentation, is the proprietary intellectual property of Karen Denning and is protected by copyright law. All rights not expressly granted in these Terms are reserved.
The ImGenBlitz name and brand are owned by Karen Denning. You may not use the ImGenBlitz name, logo, or brand in any way that implies endorsement or affiliation without our express written consent.
10. Updates and Support
Future updates to ImGenBlitz, if any, are provided at our sole discretion. Purchase of ImGenBlitz does not guarantee future updates, new features, or ongoing support. We will make reasonable efforts to maintain the Software's compatibility with OpenAI's API but cannot guarantee functionality in perpetuity as third-party services evolve.
Support is provided on a best-effort basis via email at support@imgenblitz.com. Response times are not guaranteed.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Missouri.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted at this URL with a revised effective date. Your continued use of ImGenBlitz after changes are posted constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
